Please read these Terms carefully before using Barko Rentals. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, do not use our services.
Barko Rentals LLC ("Barko," "we," "us," or "our") operates an online marketplace platform at barkorentals.com that connects boat owners ("Owners") with individuals seeking to rent boats for recreational use ("Renters"). Together, Owners and Renters are referred to as "Users."
Barko is a marketplace only. We do not own, operate, charter, or control any vessels listed on the platform. We are not a party to any rental agreement between Owners and Renters, and we are not responsible for the condition, safety, legality, or any other aspect of the boats listed.

By creating an account, you represent and warrant that you meet all of these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at contact@barkorentals.com if you suspect any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other Users or to the platform.
As an Owner, you represent and warrant that:
You are solely responsible for setting your rental terms, pricing, availability, and any rules for your vessel. Barko does not guarantee a minimum number of bookings.
As a Renter, you agree to:
You are responsible for any damage caused to the vessel during your rental period beyond normal wear and tear.
All payments are processed securely through our third-party payment provider, Stripe. By making a booking, you authorize Barko to charge your payment method for the total amount shown at checkout, including any applicable platform fees.
Barko charges a platform fee on each transaction, which is displayed before you confirm a booking. Owner payouts are processed according to our payout schedule after a booking is confirmed.
All fees are non-refundable except as described in our cancellation policy or as required by applicable law.
Cancellation terms are set by individual Owners and displayed on each listing. Renters should review the cancellation policy before booking. Barko's platform fee is generally non-refundable.
In the event of a significant issue with a booking (e.g., vessel significantly not as described, safety hazard), please contact us at contact@barkorentals.com within 24 hours of the scheduled trip start. We will review the situation and, at our sole discretion, may issue a full or partial refund.
Barko does not provide insurance coverage for Owners, Renters, or vessels. Owners are responsible for maintaining adequate insurance for their vessels. Renters are encouraged to verify that appropriate coverage is in place before completing a booking.
Barko is not liable for any injury, property damage, loss, or other harm arising from the use of any vessel listed on the platform.
You agree not to:
Violations may result in immediate account suspension or termination and may be reported to law enforcement.
Users may post reviews, messages, photos, and other content ("User Content") through the platform. You retain ownership of your User Content but grant Barko a non-exclusive, worldwide, royalty-free license to use, display, and distribute it in connection with operating and promoting the platform.
You are solely responsible for your User Content. You agree not to post content that is defamatory, obscene, infringing, or otherwise unlawful. Barko reserves the right to remove any User Content at its discretion.
All content on the Barko platform — including logos, design, software, text, and graphics — is the property of Barko Rentals LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or distribute any platform content without our prior written consent.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BARKO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
BARKO MAKES NO WARRANTY REGARDING THE ACCURACY OF LISTINGS, THE CONDUCT OF OWNERS OR RENTERS, OR THE SUITABILITY OF ANY VESSEL FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BARKO RENTALS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BARKO'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BARKO IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
You agree to indemnify, defend, and hold harmless Barko Rentals LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the platform, your User Content, your violation of these Terms, or your violation of any rights of another person or entity.
These Terms are governed by the laws of the United States and the state in which Barko Rentals LLC is registered, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of the platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
We reserve the right to update these Terms at any time. If we make material changes, we will notify you by posting a prominent notice on the platform or by sending you an email. Your continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.
We may suspend or terminate your access to the platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, disclaimers, indemnity, and limitations of liability.
